Cross-dresser found guilty of rape in bondage case

NEW ZEALAND --A Rotorua man with a fetish for cross-dressing and being tied up has been convicted of raping a woman who regularly took part in bondage sessions with him.


The jury in the Rotorua District Court trial of Gordon Murray Waite, 42, returned after less than an hour of deliberations yesterday with a guilty verdict.

After the verdict, the court heard Waite had one relevant historical conviction for exposing himself to young girls.

Waite and the woman had known each other for some time and he had been visiting her regularly at her home where she would pick out women's clothing for him, tie him up with stockings and then lock him in a wardrobe until he either freed himself or she untied him. However, one night in March last year when he visited her late at night, after she thought he had gone home, he jumped out of her wardrobe wearing only a women's g-string and raped her.

About a month later the woman laid a complaint with police after she told her estranged husband about the rape.

Waite has been on trial for the past two days.

Two video interviews with Rotorua Detective Constable Leonie Smith were played to the jury before the case closed.

In the first interview on March 14, Waite said he never raped the woman.
He said he was being set up because the woman wanted to break up his relationship with his current partner.

Waite told police the woman had thrown out her husband in December 2008 and they soon became friends which developed into his revealing his fetish to her and her taking part by dressing him in women's clothing, tying him up and locking him in a wardrobe.

He regularly went to her home at night to support her as he felt sorry for her and wanted to help her, Waite said in his interview.

"I'm a helpful guy. Hard working, around the clock," he said.
"She wanted to break us up.

"I would never rape her. I'd kill myself before doing that ... I know I have to go to counselling for this sort of thing. It's cross-dressing not killing someone or raping someone," he said.

But in his second interview with police, Waite changed his story and said the pair had consensual sex after he jumped out of her wardrobe, wearing only a g-string, and she started kissing him passionately.

"We did have sex but there was no force ... it was not rape as far as I was concerned," he said. "She lay there and we both got on with it. I do not think it was rape."

Crown Prosecutor Chris Macklin told the jury to consider all the evidence and then look at how honest the woman had been when giving her account of what happened.

"There was no drama or impulse involved. She gave you a frank, unvarnished account of what happened," he said.

"She just gave in because she thought she would be hit."
Waite didn't have her consent, Mr Macklin said.

"She is frank, she is candid ... it doesn't make sense she was making it up."

Waite's lawyer, Andy Schulze, invited the jury to acquit his client as the pair had an unusual relationship but it didn't involve rape.

"This was no neighbourhood neighbourly relationship. It developed into something that took its own life," he said.

However, on the night in question, something went amiss, Mr Schulze said.

"On this night there was a diversion," he said.

"Regret is not rape in the eyes of the law ... The devil is in the detail."
Waite has been remanded in custody for a pre-sentence report and sentencing on August 2.
