Coach says he did not violate law in BDSM sex case

NORWALK - Firelands football coach Todd Pooch did not do anything illegal when he went to a Norwalk motel to seek the services of a dominatrix, Poochs attorney Roger Stark said. Pooch, 36, of Huron, pleaded innocent yesterday to soliciting prostitution.
It appears, from everything we have seen so far, that Huron County is trying to criminalize something that is not illegal, Stark said. He was not there for sex. He was not soliciting sex. There was no exchange of money for sex. He was going there for the dominatrix; it was not sexual in any way and that is not illegal at all.
Pooch was arrested in a sting that came about following the arrest of another man last week.
Huron County Sheriffs Capt. Ted Patrick said the sheriffs office received a tip that 53-year-old Douglas Lucas was running a brothel out of his Ninevah Road home in Greenwich.
Customers seeking bondage and sadomasochism services were often located by Lucas through a website that catered to bondage and sadomasochism, Patrick said.
Lucas was arrested Sept. 1 for promoting prostitution. Deputies believe he may have been running the brothel for about two to three months.
Pooch, and another man, 52-year-old John Kemper, of Brunswick, made appointments for sex via the website and showed up at a motel room deputies had rented for a sting operation, Patrick said. Deputies had surveillance set up in the motel room, along with various bondage props.
Both men requested a number of bondage services in exchange for money. One man wanted to be tied up and beaten, and another wanted sex acts performed while he sat in a dog cage. Patrick would not elaborate on which requests came from Pooch. He also would not say how much money was exchanged, but only said it was a substantial amount.
Stark said this was not true and also said there was no discussion or offer of money for sex. Stark also said Pooch has no link or connection to Kemper or Lucas.
The woman who met the men, Stark said, was one of Lucas prostitutes and used by police officers to implicate other men to lessen the charges she and Lucas face. Stark said the woman, of Alaska, whose identity has not been revealed, used police officers and instead tricked them into prosecuting innocent men.
There was no sex involved and there was no sex discussed, Stark said of the woman, adding requesting the services of a dominatrix is not illegal according to Ohio law.
(Pooch) expects to be found not guilty, because again, they are charging for soliciting and, in Ohio law, its very specific, its when you offer money for sexual services. And there were no sexual services and no money.
Stark said Pooch is unmarried and the acts were between consenting adults, where nobody gets hurt.
Nobody has any kind of problem. There were no kids involved. This wasnt anything associated with the schools. Its not Romeo and Juliet, but its also not something that is illegal, either. No matter what the maximum sentence the court could do, hes already suffered 10 times that.
Pooch is also a satellite teacher for Lorain County Joint Vocational School, but he teaches on the Firelands High School campus. He previously coached at Western Reserve and Margaretta schools. Lorain County JVS Superintendent John Nolan said Pooch has been placed on administrative leave until further investigation.
Firelands Superintendent Greg Ring said Friday he had no comment and was simply waiting on the investigation. The Falcons assistant coach and defensive coordinator will be stepping in during Poochs absence.
(Pooch) is devastated because he didnt do anything wrong and the exposure that he has suffered is devastating. His family is rallying around him and he has an awful lot of friends, but professionally, this is devastating, Stark said.
Pooch and Stark will meet with prosecutors Wednesday for the first pretrial hearing. Lucas, who was charged with a felony count of promoting prostitution, has a preliminary hearing on Sept. 23. Kemper pleaded innocent to soliciting prostitution but a court date has not yet been set.
