Rowayton photographer accused of fondling model in bondage shoot pleads not guilty

USA- A Rowayton-based photographer accused of fondling a model during a bondage photo shoot pleaded not guilty to the crime Tuesday at Norwalk Superior Court.
James Lipay, 63, of 16 Juniper Road, is charged with fourth-degree sexual assault. He is free on $1,000 bond, and his next court date is Nov. 9.
Lipay's attorney, Michael Skiber, said he needs to conduct more investigation before moving forward with the case.
"This is a case that comes down to whether or not there was consent," he said.
Police said the woman signed a consent form to shoot bondage photos and agreed to meet at Lipay's home on Aug. 25.
The woman even provided Velcro ties that she could easily remove if necessary, but Lipay insisted on using a rope, which he then tied around her neck and wrists, court documents show.
The affidavit states that Lipay blindfolded the woman, unzipped her dress and unfastened her bra and began snapping photos.
But the woman claims she felt "uncomfortable and violated" when Lipay allegedly removed her bra and touched her bare breasts.
According to the affidavit, Lipay then moved behind the woman, slid his hand down the front of her underwear and touched her genitalia. She told police that she did not finish the shoot, and she returned Aug. 28
The model returned on the afternoon of Aug. 28 accompanied by a friend, and the two proceeded to question Lipay about a workshop he organizes called "New Haven pin-up and artistic photography," which pays a $200 show-up fee.
