Rowayton photographer accused of inappropriately touching a model

USA- ROWAYTON- A Rowayton photographer accused of inappropriately touching a model during a bondage photo shoot turned down the accelerated rehabilitation program Tuesday at Norwalk Superior Court and will take his case to trial.
James Lipay, 63, of 16 Juniper Road, is charged with fourth-degree sexual assault, a Class A misdemeanor that would be expunged from Lipay's record if he successfully completed the accelerated rehabilitation program. Lipay does not have a criminal record.
Lipay is adamant about his innocence, and he plans to sue the complainant in the case for defamation of character, according to his attorney Michael Skiber.
"He's out to prove his innocence, and accelerated rehabilitation doesn't prove his innocence, although he is eligible," Skiber said.
Police said the woman signed a consent form to shoot bondage photos and agreed to meet at Lipay's home on Aug. 25.
The woman even provided Velcro ties that she could easily remove if necessary, but Lipay insisted on using a rope, which he then tied around her neck and wrists, court documents show.
The affidavit states that Lipay blindfolded the woman, unzipped her dress and unfastened her bra and began snapping photos.
But the woman claims she felt "uncomfortable and violated" when Lipay allegedly removed her bra and touched her bare breasts.
According to the affidavit, Lipay then moved behind the woman, slid his hand down the front of her underwear and touched her genitalia. She told police that she did not finish the shoot.
