Jury to decide fate of photog

USA - NORWALK - The fate of a Rowayton photographer accused of fondling a model during a bondage themed photo shoot could be decided today at Norwalk Superior Court, as the jury in his trial will be charged after hearing closing arguments
James Lipay, 64, took the stand during the second day of his fourth-degree sexual assault trial, calling his accuser in the case "desperate" and hinting that she plotted against him after he called her friend "revolting."
Norwalk Police arrested Lipay on Sept. 18, 2010, after a 33-year-old woman alleged that Lipay touched her breasts and genitalia without consent during a bondage-themed photo shoot in August 2010.
The state offered Lipay accelerated rehabilitation on more than one occasion, but he rejected the offers, choosing instead to try and clear his name by taking his case to trial.
The complainant took the stand Monday admitted to sending Lipay explicit hardcore bondage photos prior to the photo shoot. Lipay admitted Tuesday that he "tweaked" the girl's nipples using his mouth.
Lipay testified that he shot photos of the complainant in three different locations immediately after the lewd conduct allegedly took place, and the complainant did not express any discomfort during the photo shoot, police said.
The complainant and her friend returned to Lipay's home three days after the initial photo shoot, and Lipay became uncomfortable when the complainant's friend demanded to model for him.
He said the complainant became agitated after he insulted her friend, who he referred to as a "fetish wierdo" during his testimony.
