USA - DOVER N.H. - Star witness Kathryn “Kat” McDonough - who sobbed uncontrollably yesterday as she described a strip poker game that ended in the bondage-rope murder of a UNH student - is expected to face a blistering cross-examination this afternoon as the defense attempts to point the finger at her as the murderer.
The 20-year-old who said she witnessed the strangulation of Elizabeth “Lizzi” Marriott, 19, of Westboro, placed all the blame on her ex-boyfriend Seth Mazzaglia, 31, saying his obsession for sex games drove him to kill.
But after McDonough finishes telling her gripping story, the defense will get its chance to shred her version of events. They claim McDonough killed Marriott in a bondage sex act while Mazzaglia was out of the room. “She made a compelling witness, but now it’s the defense’s job to make her unravel, and they probably have information we don’t know,” said Steven Shadallah, a longtime
New Hampshire defense attorney not involved in this case. “They will try to attack her credibility and that she took a lesser sentence.”
Marriott’s body has never been found. In exchange for her testimony, McDonough cut a plea deal for lying to investigators that will have her serving no more than three years in prison. Her stunning turn on the witness stand could also force Mazzaglia to testify - a rare occurrence in a murder trial.
“If you have two stories, and two people pointing at each other, that could be something you’ll see. We don’t like putting our clients on the stand, but the jury might be thinking, if this is ‘he said, she said,’ we want to hear what he has to say,” said Mark Osborne, a criminal defense attorney and former Granite State prosecutor also not involved in the case.
McDonough forced the court into recess yesterday as she broke down describing the last moments of Marriott’s life. She testified that Marriott - then a sophomore at the University of New Hampshire - was strangled with a bondage rope the night of Oct. 9, 2012, after she refused to watch her and Mazzaglia engage in sex after the three had finished a strip poker game. McDonough said her friend let out a final gasp as
Mazzaglia pounced on her. “Her arms curled up against her chest and her eyes were closed. I didn’t know what to do,” McDonough said. She then heard Marriott make a sound as she was dying: “I could best describe it as shock,” she said.
McDonough admitted she did nothing to stop the killing, testifying the strangulation “seemed like forever.” She said Marriott was “limp” and had no pulse when Mazzaglia had sex with the body while swearing at the teen.
She also said she and Mazzaglia agreed to “cover up the murder.” McDonough testified they jammed Marriott’s remains into a suitcase, but because she didn’t fit they had to duct-tape it shut.
“She was bent awkwardly,” McDonough said.
She and her ex-beau then drove the body to Peirce Island near Portsmouth and tossed it over a cliff, but when it didn’t land in the water, she climbed down and set it afloat covered in
seaweed, she said. The defense has claimed McDonough then said, “Welcome to Davy Jones’ locker.”
As part of the cover-up, she said she sent a nowdead Marriott a text message asking, “Are you still coming?”
But yesterday, a tearful McDonough said of Marriott, “She’ll never get to get married. She’ll never ...have kids. It was because of us that she never got to have her life.”
